AN ACT

RELATING TO MEDICAL ASSISTANCE; ENACTING A SECTION OF THE PUBLIC ASSISTANCE ACT TO REQUIRE THE SECRETARY OF HUMAN SERVICES TO SUBMIT A FISCAL IMPACT STATEMENT AND DESCRIPTION OF PROPOSED CHANGES WHEN MAKING CERTAIN CHANGES TO THE STATE'S MEDICAID PROGRAM.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Public Assistance Act is enacted to read: 

     "[NEW MATERIAL] MEDICAID PLAN AMENDMENTS--FISCAL IMPACT STATEMENT.--

          A. The secretary shall submit a fiscal impact statement and description of proposed changes to the legislative finance committee and the department of finance and administration at least sixty days, or as soon as practicable, prior to submitting for federal approval:

                (1) amendments to the medicaid state plan;

                (2) a waiver of state medicaid plan requirements; or

                (3) amendments to an existing waiver of state medicaid plan requirements.

          B. Nothing in this section shall require the secretary to submit a fiscal impact statement or a description of proposed changes pursuant to this section for proposed technical adjustments that the secretary deems not to have any expected fiscal impact to the medicaid state plan or a medicaid waiver."
