AN ACT

RELATING TO LOCAL GOVERNMENTS; ENACTING A NEW SECTION OF THE MUNICIPAL CODE TO PROVIDE FOR PASSENGER ACCESS TO COMMON MOTOR CARRIERS.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Municipal Code is enacted to read:

     "[NEW MATERIAL] CITATIONS TO COMMON MOTOR CARRIERS--PASSENGER ACCESS.--No traffic citation shall be issued by a municipality to a common motor carrier for violation of a local ordinance if the municipality has not provided for convenient passenger access for persons seeking services of common motor carriers near areas of pedestrian concentrations, including:

          A. alcohol-serving establishments;

          B. sports and entertainment venues; and

          C. hotels."
