AN ACT

RELATING TO CRIMINAL HISTORY RECORDS; AUTHORIZING THE DEPARTMENT OF PUBLIC SAFETY TO PROVIDE UPDATES TO CRIMINAL HISTORY RECORD CHECKS; REQUIRING THAT AN UPDATE BE PROVIDED ONLY TO AN AGENCY AUTHORIZED BY LAW TO RECEIVE INFORMATION ON A PARTICULAR RECORD.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. UPDATES TO CRIMINAL HISTORY RECORDS.--The department of public safety shall maintain an electronic subscription service to provide notice of updates to criminal history records for agencies authorized by law to receive particular criminal history record information. The department shall update criminal history repository records pursuant to any change in information discovered by the department. Within forty-eight hours after the department becomes aware that an individual's criminal history record information in a repository record has changed, the department shall provide notice of the updated information to any agency authorized by law to receive information on that particular record.
