AN ACT

RELATING TO HIGHWAYS; ESTABLISHING A PRIORITY FOR HIGHWAYS ON TRIBAL LAND.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. PRIORITY FOR HIGHWAY REPAIRS AND MAINTENANCE ON TRIBAL LAND.--Consistent with applicable federal law, the state transportation commission shall prioritize repairs and maintenance of any state highway that extends into or through tribal land above all other projects, including those contained in the statewide transportation improvement program. For the purposes of this section "tribal land" means the reservation, pueblo grant or trust land of a tribe and property held by the United States in trust jointly for the nineteen New Mexico Indian pueblos pursuant to Public Law 95-232.
