AN ACT

RELATING TO HEALTH CARE; REQUIRING PUBLIC HEALTH FACILITIES THAT OFFER SUBSTANCE ABUSE TREATMENT PROGRAMS TO PROVIDE FAMILY PLANNING SERVICES TO PATIENTS SEEKING SUBSTANCE ABUSE TREATMENT.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. Section 24-8-1 NMSA 1978 (being Laws 1973, Chapter 107, Section 1) is amended to read:

     "24-8-1. SHORT TITLE.--[This act] Chapter 24, Article 8 NMSA 1978 may be cited as the "Family Planning Act"."

     SECTION 2. A new section of the Family Planning Act is enacted to read:

     "[NEW MATERIAL] PUBLICLY FUNDED HEALTH FACILITIES--SUBSTANCE ABUSE TREATMENT PROGRAMS.--A publicly funded health facility that provides a substance abuse treatment program shall assess whether a patient is in need of family planning services, and if it is determined that the patient is in need of family planning services, the facility shall:

          A. provide family planning services to the patient; or

          B. refer the patient for family planning services if those services are not available at the health facility."
