AN ACT

RELATING TO LAW ENFORCEMENT; PROHIBITING INQUIRY INTO IMMIGRATION STATUS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. INQUIRY INTO IMMIGRATION STATUS PROHIBITED.--

          A. A law enforcement agency or a law enforcement officer of the state or a political subdivision of the state shall not inquire into the immigration status of a person. A law enforcement agency or a law enforcement officer of the state or a political subdivision of the state shall not enforce federal civil immigration laws.

          B. As used in this section, "immigration status" means whether a person is a United States citizen or a citizen of any other country; whether a person has the legal right to reside or be present in the United States; or information pertaining to the time or manner of a person's entry into the United States.
