Your CONSERVATION COMMITTEE, to whom has been referred
SENATE BILL 500
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 8, line 2, strike "and".
2. On page 8, line 12, after "approved", insert the following:
"; and
(4) if a person files an application for approval of a transmission line that has been approved by a regional transmission organization or other transmission planning coordinator, the commission shall issue a final order on the application within one hundred twenty days after the date the application was filed, notwithstanding any other provision of this section allowing for additional time for consideration by the commission, or the application shall be deemed approved. The commission may approve the application notwithstanding the prior disapproval of a county or municipal agency, board or commission, and the judgment of the commission shall be conclusive on all questions of siting, land use, aesthetics and any other state or local requirements affecting the siting. As used in this paragraph, "transmission line" means an electric transmission line and associated facilities designed for or capable of operations at a nominal voltage of two hundred thirty kilovolts or more.".
3. On page 9, strike lines 16 through 25 in their entirety, strike all of page 10 and strike page 11 up to the quotation marks.,
and thence referred to the JUDICIARY COMMITTEE.
