AN ACT

RELATING TO CORRECTIONS; REQUIRING THE MOST RESTRICTIVE CUSTODY LEVEL FOR INMATES SENTENCED TO LIFE IMPRISONMENT WITHOUT POSSIBILITY OF RELEASE OR PAROLE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Corrections Act is enacted to read:

     "[NEW MATERIAL] LIFE IMPRISONMENT WITHOUT POSSIBILITY OF RELEASE OR PAROLE--CUSTODY LEVEL.--An inmate sentenced to life imprisonment without possibility of release or parole shall be deemed to pose the greatest risk to the security of the institution and the safety of others and shall be housed in the most restrictive custody and at the highest security level within the corrections department."

     SECTION 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2011.
