A JOINT RESOLUTION

PROPOSING TO AMEND ARTICLE 8 OF THE CONSTITUTION OF NEW MEXICO BY ADDING A NEW SECTION TO REQUIRE A VOTE OF TWO-THIRDS OF MEMBERS PRESENT AND VOTING IN EACH HOUSE TO APPROVE A NEW TAX OR AN INCREASE IN THE TAX RATE OF AN EXISTING TAX.

 

BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. It is proposed to amend Article 8 of the constitution of New Mexico by adding a new section to read:

     "A new tax that applies statewide or an increase in the rate of an existing statewide tax may be provided by law if approved by a two-thirds majority vote of members present and voting in each house of the legislature."

     SECTION 2. The amendment proposed by this resolution shall be submitted to the people for approval or rejection at the next general election or at any special election prior to that date that may be called for that purpose.
