AN ACT

RELATING TO LOCAL GOVERNMENT AGENCIES; PROVIDING FOR REFUND OF FEES WITHOUT REQUIRING PERSONAL APPEARANCE OR PROOF OF CHECK CLEARANCE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. LOCAL GOVERNMENT AGENCIES--REFUND OF FEES PAID.--

          A. When a person requests a full or partial refund of fees paid to a local government agency more than fifteen days after the fee was paid, the local government agency shall not require that person to appear in person to make that request nor to provide proof that any check used to pay the fee has been cleared by the paying bank.

          B. As used in this section:

                (1) "check" means a draft payable on demand and drawn on a bank; and

                (2) "local government agency" means a political subdivision of the state or an agency of a political subdivision of the state.

     SECTION 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2013.
