    Your CONSUMER AND PUBLIC AFFAIRS COMMITTEE, to whom has been referred

HOUSE BILL 431

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

     1. On page 1, line 12, after "VEHICLE", insert "DECLARED A PUBLIC NUISANCE".

     2. On page 1, line 14, after the semicolon, insert "PROVIDING FOR EXCLUSIONS;".

     3. On page 4, line 22, after "license", insert "or privilege to drive".

     4. On page 6, line 7, after "driving", insert "shall be declared a public nuisance,".

     5. On page 6, line 12, after the period, insert:

     "A home rule municipality or other political subdivision of the state that has established or establishes vehicle forfeiture procedures for a person arrested pursuant to the provisions of this section whose license or privilege to drive is revoked at the time of the arrest due to a conviction for driving under the influence of intoxicating liquor or drugs or a violation of the Implied Consent Act is excluded from the provisions of this subsection.".

     6. On page 6, line 13, after "license" insert "or privilege to drive".,

and thence referred to the JUDICIARY COMMITTEE.
