FOR THE LEGISLATIVE HEALTH AND HUMAN SERVICES COMMITTEE

 

AN ACT

RELATING TO HEALTH CARE; REQUIRING HEALTH FACILITIES THAT OFFER SUBSTANCE ABUSE TREATMENT PROGRAMS TO WOMEN TO OFFER SERVICES TO PREGNANT WOMEN.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Public Health Act is enacted to read:

     "[NEW MATERIAL] LICENSING REQUIREMENTS FOR HEALTH FACILITIES THAT OFFER SUBSTANCE ABUSE TREATMENT PROGRAMS.--The department shall issue a license to a health facility that offers substance abuse treatment programs to women only if that facility otherwise meets the requirements for licensure under state law and department rules and agrees to:

          A. offer the same services it offers to all women to pregnant women with substance abuse disorders, unless otherwise medically indicated; and

          B. give preference in admissions to a pregnant woman who seeks or is referred to the health facility for treatment of a substance abuse disorder."
