AN ACT

RELATING TO PUBLIC SCHOOLS; ESTABLISHING A ONE-YEAR MORATORIUM ON THE CREATION OF CERTAIN ONLINE CHARTER SCHOOLS; DECLARING AN EMERGENCY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. TEMPORARY PROVISION--ONLINE CHARTER SCHOOLS MORATORIUM.--From June 1, 2013 through May 31, 2014, no initial applications for charter schools that propose to provide a full-time online program to students shall be accepted or approved by a chartering authority in order to allow the public education department, in coordination with the legislative education study committee, a year in which to review outstanding questions and issues regarding the impact of full-time online charter schools on students and school systems; to identify sections of state law that may affect or be affected by the establishment of full-time online charter schools; and, if necessary, to propose changes to the law to accommodate and regulate full-time online charter schools.

     SECTION 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
