    Your PUBLIC AFFAIRS COMMITTEE, to whom has been referred


SENATE BILL 409


has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:


    1. On page 1, line 14, before the period, insert "; ALLOWING THE USE OF AN ALCOHOL-MONITORING ANKLE BRACELET; DEFINING "DRUG"".


    2. On page 3, line 20, strike "L" and insert in lieu thereof "M".


    3. On page 7, between lines 12 and 13, insert a new subsection to read:


         "L. In lieu of incarceration, an offender sentenced to time in jail or prison pursuant to this section, including mandatory jail or prison in excess of six months, may be sentenced to wear an alcohol-monitoring ankle bracelet.".


    4. Reletter the succeeding subsections accordingly.


    5. On page 11, between lines 2 and 3, insert a new paragraph to read:


              "(1) "alcohol-monitoring ankle bracelet" means a secure continuous remote alcohol-monitoring device worn on the ankle that uses transdermal alcohol monitoring and allows for continuous monitoring of the offender's alcohol concentration twenty-four hours per day seven days per week for the duration of the supervision period;".


    6. Renumber the succeeding paragraphs accordingly.


    7. On page 11, line 7, strike "and".


    8. On page 11, line 21, strike the period and ending quotation mark and insert in lieu thereof "; and


             (4) "drug" means any substance described in the Controlled Substances Act that is synthetic or naturally occurring, whether in solid or vapor form, that causes impairment in individuals."".,


and thence referred to the JUDICIARY COMMITTEE.
