AN ACT

RELATING TO ECONOMIC DEVELOPMENT; PROVIDING FOR A JOINT POWERS AGREEMENT BETWEEN THE HIGHER EDUCATION DEPARTMENT, THE DEPARTMENT OF TRANSPORTATION AND THE CORRECTIONS DEPARTMENT FOR THE PURPOSE OF ADVANCING THE OPERATION OF THE SPRINGER CORRECTIONAL CENTER AND DEVELOPING THE ECONOMY RELATED TO THE CENTER; MAKING AN APPROPRIATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. SPRINGER CORRECTIONAL CENTER--JOINT POWERS AGREEMENT.--

          A. The corrections department, the department of transportation and the higher education department on behalf of Luna community college shall enter into a joint powers agreement, pursuant to the Joint Powers Agreements Act, for the purpose of advancing the operation of the Springer correctional center and developing the economy in the community that serves the center. Other entities may join the agreement if approved by their governing bodies. The agreement shall be entered into no later than August 1, 2013.

          B. The joint powers agreement shall address employee vacancies at the Springer correctional center, the availability and quality of housing for employees of the center, transportation services available for employees who commute to the center from surrounding communities, a farm program at the center that incorporates inmate rehabilitation and inmate vocational training and the expansion of vocational training and education programs offered at the center by Luna community college.

          C. One hundred thousand dollars ($100,000) is appropriated from the general fund to the corrections department for expenditure in fiscal year 2014 to carry out the purposes of the joint powers agreement called for in this section. Any unexpended or unencumbered balance remaining at the end of fiscal year 2014 shall revert to the general fund. No later than August 1, 2014, the corrections department shall provide a written report to the legislative finance committee and to the economic development department providing a summary of the actions completed pursuant to the joint powers agreement, an overview of future actions planned and a statement detailing how the appropriation made pursuant to this section was used.
