AN ACT

RELATING TO EXECUTIVE AGENCIES; REQUIRING AGENCY PERSONNEL BUDGETS TO BE USED BY THE AGENCY FOR AGENCY PERSONNEL.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. TEMPORARY PROVISION--DISTRIBUTION OF UNEXPENDED BALANCES IN AGENCY ACCOUNTS FOR PERSONAL SERVICES AND EMPLOYEE BENEFITS REMAINING AT THE END OF FISCAL YEAR 2015.--Notwithstanding the budget adjustment authority provided in the General Appropriation Act of 2014, an executive agency shall not transfer money out of personal services and employee benefits. At the end of fiscal year 2015, money in an executive agency's personal services and employee benefits shall not revert to the general fund but shall be distributed to all of the agency's full-time-equivalent employees that are employed on July 1, 2015 and that were employed during fiscal year 2015 in equal shares, prorated by the number of pay periods worked. The distribution provided in this section is effective the first pay period after July 1, 2015.

     SECTION 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2014.
