AN ACT

RELATING TO PUBLIC EDUCATION; ENACTING STANDARDS FOR THE IMPLEMENTATION OF THE COMMON CORE STANDARDS AND THE PARTNERSHIP FOR ASSESSMENT OF READINESS FOR COLLEGE AND CAREERS ASSESSMENT AND THE SMARTER BALANCED ASSESSMENT; PLACING A THREE-YEAR MORATORIUM ON THE USE OF THE PARTNERSHIP FOR ASSESSMENT OF READINESS FOR COLLEGE AND CAREERS ASSESSMENT OR THE SMARTER BALANCED ASSESSMENT FOR THE PURPOSES OF THE PROMOTION POLICIES IN THE ASSESSMENT AND ACCOUNTABILITY ACT, THE A-B-C-D-F SCHOOLS RATING ACT AND THE SCHOOL PERSONNEL ACT AND AS A GRADUATION REQUIREMENT.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Public School Code is enacted to read:

     "[NEW MATERIAL] IMPLEMENTATION OF COMMON CORE STANDARDS AND PARTNERSHIP FOR ASSESSMENT OF READINESS FOR COLLEGE AND CAREERS ASSESSMENT OR SMARTER BALANCED ASSESSMENT.--The department shall:

          A. provide sufficient professional development, pursuant to Section 22-10A-19.1 NMSA 1978, and resources for each teacher, school principal and educational support provider to successfully:

                (1) instruct students on the common core standards that, in contrast to the academic standards mandated prior to the 2014-2015 school year, emphasize learning depth over breadth;

                (2) instruct students on understanding, analyzing and successfully performing the tasks required by the partnership for assessment of readiness for college and careers assessment or the smarter balanced assessment or any other standards-based assessment that, in contrast to standards-based assessments mandated prior to the 2014-2015 school year, require students to demonstrate their analytical processes using an online testing format;

                (3) instruct students on using educational technology to take the partnership for assessment of readiness for college and careers assessment or the smarter balanced assessment or any other standards-based assessment; and

                (4) align instruction on the common core standards with instruction on taking the partnership for assessment of readiness for college and careers assessment or the smarter balanced assessment or any other standards-based assessment;

          B. guarantee the sufficiency and availability of educational technology and educational technology infrastructure to increase the likelihood of student performance success on the partnership for assessment of readiness for college and careers assessment or the smarter balanced assessment or any other standards-based assessment that may be administered to a student;

          C. establish a student performance baseline from scores received on the partnership for assessment of readiness for college and careers assessment or the smarter balanced assessment or any other standards-based assessment that is administered during the 2014-2015, 2015-2016 and 2016-2017 school years;

          D. provide support for the goal of continually improving students' mean scores on the partnership for assessment of readiness for college and careers assessment or the smarter balanced assessment or any other standards-based assessment; and

          E. develop and provide an alternative track for college and workplace readiness for students in grade twelve who do not attain a proficient score on the partnership for assessment of readiness for college and careers assessment or the smarter balanced assessment or any other standards-based assessment."

     SECTION 2. A new section of the Assessment and Accountability Act is enacted to read:

     "[NEW MATERIAL] USE OF PARTNERSHIP FOR ASSESSMENT OF READINESS FOR COLLEGE AND CAREERS ASSESSMENT AND SMARTER BALANCED ASSESSMENT RESTRICTED.--The department shall not use and shall not require the use of the partnership for assessment of readiness for college and careers assessment or the smarter balanced assessment for making grade promotion decisions pursuant to Section 22-2C-6 NMSA 1978."

     SECTION 3. Section 22-2E-1 NMSA 1978 (being Laws 2011, Chapter 10, Section 1) is amended to read:

     "22-2E-1. SHORT TITLE.--[Sections 1 through 4 of this act] Chapter 22, Article 2E NMSA 1978 may be cited as the "A-B-C-D-F Schools Rating Act"."

     SECTION 4. A new section of the A-B-C-D-F Schools Rating Act is enacted to read:

     "[NEW MATERIAL] USE OF PARTNERSHIP FOR ASSESSMENT OF READINESS FOR COLLEGE AND CAREERS ASSESSMENT AND SMARTER BALANCED ASSESSMENT RESTRICTED.--The department shall not use and shall not require the use of the partnership for assessment of readiness for college and careers assessment or the smarter balanced assessment for any purpose under the A-B-C-D-F Schools Rating Act."

     SECTION 5. A new section of the School Personnel Act is enacted to read:

     "[NEW MATERIAL] USE OF PARTNERSHIP FOR ASSESSMENT OF READINESS FOR COLLEGE AND CAREERS ASSESSMENT AND SMARTER BALANCED ASSESSMENT RESTRICTED.--The department shall not use and shall not require the use of the partnership for assessment of readiness for college and careers assessment or the smarter balanced assessment for employment or licensure decisions or any other purpose under the School Personnel Act."

     SECTION 6. A new section of Chapter 22, Article 13 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] USE OF PARTNERSHIP FOR ASSESSMENT OF READINESS FOR COLLEGE AND CAREERS ASSESSMENT AND SMARTER BALANCED ASSESSMENT RESTRICTED.--The department shall not use and shall not require the use of the partnership for assessment of readiness for college and careers assessment or the smarter balanced assessment as a graduation requirement pursuant to Section 22-13-1.1 NMSA 1978."

     SECTION 7. DELAYED REPEAL.--Effective July 1, 2018, Sections 2 and 4 through 6 of this act are repealed.

     SECTION 8. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2015.
