AN ACT

RELATING TO MOTOR VEHICLES; ADDRESSING THE TITLING AND REGISTRATION OF REPLICA CARS; PROVIDING AN EXCEPTION FROM EMISSIONS TESTING.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Motor Vehicle Code is enacted to read:

     "[NEW MATERIAL] REPLICA CAR TITLING AND REGISTRATION.--

          A. As used in this section:

                (1) "model year" means the year of manufacture

of the motor vehicle model or brand that a replica car most resembles in outward appearance as described by the manufacturer in published information; and

                (2) "replica car" means a motor vehicle that is assembled from a pre-fabricated chassis and body kit purchased from a replica car manufacturer.

          B. On application to the department, the owner of a

replica car may receive a certificate of title, registration and registration plate by:

                (1) paying the appropriate current fees for a motor vehicle other than a motorcycle, truck, bus or tractor;

                (2) submitting a witnessed bill of sale for the replica car or an affidavit from the owner that the owner assembled the replica car;

                (3) submitting an affidavit that the replica car shall be maintained only for occasional transportation, exhibitions, vehicle club activities, parades, tours and similar limited uses and that the replica car shall not be used for general or daily transportation; and

                (4) providing evidence acceptable to the department that the replica car meets safety and equipment requirements pursuant to the Motor Vehicle Code; provided that a replica car need not have equipment that was not required by state or federal law in its model year.

          C. The date of manufacture of a replica car for title and registration purposes is the model year.

          D. A replica car to be registered or currently registered pursuant to this section:

                (1) is exempt from a state or local law or ordinance requiring periodic vehicle or vehicle emission inspections and testing; and

                (2) except as provided in Paragraph (4) of Subsection B of this section, is subject to Section 66-3-901 NMSA 1978.

          E. Upon the transfer of ownership of a replica car, the new owner shall apply to the department for a new certificate of title and registration pursuant to Section 66-3-103 NMSA 1978."

     SECTION 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2015.
