AN ACT

RELATING TO PUBLIC HEALTH; MAKING THE USE, SALE, OFFER OR POSSESSION OF POWDERED ALCOHOL ILLEGAL; PROHIBITING THE USE OF POWDERED ALCOHOL TO PREPARE ALCOHOLIC BEVERAGES FOR SALE; PROVIDING FOR PENALTIES AND FINES; DECLARING AN EMERGENCY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of Chapter 60, Article 7A NMSA 1978 is enacted to read:

     "[NEW MATERIAL] POWDERED ALCOHOL PROHIBITED.--

          A. As used in this section, "powdered alcohol" means alcohol prepared or sold in a powder form for either direct use or reconstitution.

          B. It is unlawful:

                (1) to use, offer for use, purchase, offer to purchase, sell, offer to sell or possess powdered alcohol; or

                (2) for a person licensed to sell alcoholic beverages to use powdered alcohol in the preparation of alcoholic beverages.

          C. A person who violates any provision of this section is guilty of a fourth degree felony and shall be sentenced according to the provisions of Section 31-18-15 NMSA 1978."

     SECTION 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
