AN ACT

RELATING TO PUBLIC SCHOOLS; CREATING THE PUBLIC EDUCATION DATA ADVISORY COUNCIL TO REVIEW AND ADVISE THE PUBLIC EDUCATION DEPARTMENT REGARDING THE DATA USED FOR SCHOOL GRADES AND TEACHER EVALUATIONS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. [NEW MATERIAL] PUBLIC EDUCATION DATA ADVISORY COUNCIL CREATED--MEMBERSHIP--POWERS AND DUTIES--STAFF.--

          A. The "public education data advisory council" is created to review and advise the public education department on the accuracy and validity of data and calculations used for school grades and teacher evaluations.

          B. The council shall consist of seven members, as follows:

                (1) the director of the assessment and accountability division at the public education department;

                (2) four individuals with expertise in complex statistics, mathematics, social sciences or education statistics, one each appointed by the majority floor leader of the senate, the minority floor leader of the senate, the speaker of the house of representatives and the minority floor leader of the house of representatives;

                (3) one staff member of the legislative education study committee appointed by the director of that committee; and

                (4) one staff member of the legislative finance committee appointed by the director of that committee.

          C. The department shall provide the council any data, calculations or related information, such as mathematical formulas, used in the calculations of school grades and educator evaluations upon request of the council; provided, however, that any student- or teacher-level information reviewed by the council shall remain confidential.

          D. The council shall report to the legislative education study committee and the legislative finance committee at their December meetings on the accuracy and validity of data and calculations used for school grades and teacher evaluations and on any recommendations for the department or the legislature.
