Mr. President:
Your EDUCATION COMMITTEE, to whom has been referred
SENATE BILL 283
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 1, lines 12 and 13, strike "PROVIDING A PRIVATE RIGHT OF ACTION;".
2. On page 2, between lines 7 and 8, insert the following new paragraph:
"(3) "physical escort" means the brief, gentle touching or holding of a hand, wrist, arm, shoulder, waist, hip or back for the purpose of inducing a student to move to a safe location;".
3. On page 2, between lines 11 and 12, insert the following new paragraph:
"(5) "prone restraint" means to restrain a student in a face-down position;".
4. On page 2, line 21, strike "and".
5. On page 3, line 1, strike the period and insert in lieu thereof "; and", and between lines 1 and 2, insert the following new paragraph:
"(10) "time out" means a behavior management technique that may involve allowing a student to voluntarily separate from the group for the purpose of calming, if there is no restriction on the student's ability to rejoin the group at will and such separation is not to a location from which the student cannot voluntarily rejoin the group.".
6. Renumber paragraphs to correspond to these amendments.
7. On page 3, line 7, after "interventions", insert ", which shall not be included in individual education program or emergency plan documents for individual students,".
8. On pages 4 and 5, strike Subsection C in its entirety.
9. Reletter the succeeding subsection accordingly.,
and thence referred to the JUDICIARY COMMITTEE.
