AN ACT

RELATING TO PROCUREMENT; SPECIFYING NONDISCLOSURE REQUIREMENTS; MAKING TECHNICAL CORRECTIONS.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. Section 13-1-116 NMSA 1978 (being Laws 1984, Chapter 65, Section 89) is amended to read:

     "13-1-116. COMPETITIVE SEALED PROPOSALS--DISCLOSURE--RECORD.-- 

          A. The contents of proprietary or financial documentation contained in a proposal shall not be disclosed.

          B. During the negotiation process, the contents of [any] a proposal shall not be disclosed [so as to be available to competing offerors during the negotiation process]."
