A MEMORIAL

REQUESTING THE APPROPRIATE INTERIM LEGISLATIVE COMMITTEE TO STUDY ISSUES RELATING TO PARENTAL RIGHTS.

 

     WHEREAS, the right of parents to direct the upbringing, care and education of their minor children is fundamental;

     NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE STATE OF NEW MEXICO that the appropriate interim legislative committee be requested to study the following issues relating to parental rights in New Mexico:

          A. the manner in which other state legislatures and the United States congress have addressed the issue of the rights of parents in the upbringing of their children;

          B. what compelling governmental interests could justify interfering with parental rights on various issues;

          C. whether parental rights extend to other than biological parents; and

          D. any other matters necessary in conducting the study; and

     BE IT FURTHER RESOLVED that the committee be requested to report its conclusions to the second session of the fifty-second legislature; and

     BE IT FURTHER RESOLVED that copies of this memorial be transmitted to the co-chairs of the New Mexico legislative council.
