Your JUDICIARY COMMITTEE, to whom has been referred
HOUSE FLOOR SUBSTITUTE FOR
HOUSE JUDICIARY COMMITTEE SUBSTITUTE FOR
HOUSE REGULATORY AND PUBLIC AFFAIRS COMMITTEE SUBSTITUTE FOR HOUSE BILL 72, as amended
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. Strike Senate Public Affairs Committee Amendment 4.
2. On page 1, line 14, strike "OR AN ALTERATION OF A BASIC SENTENCE".
3. On page 2, line 1, after the period, insert the following:
"If a judge considers the juvenile disposition of a youthful offender or evidence given in a hearing for the youthful offender pursuant to this section, the disposition and evidence shall be considered confidential and shall be reviewed or discussed in camera. All evidence, motions or other documents or evidence pertaining to the juvenile disposition shall be sealed, unless otherwise considered not to be confidential by law.".
4. On pages 2 and 3, strike Section 2 in its entirety.
5. Renumber the succeeding section accordingly.
6. On page 6, line 4, after the period, strike the remainder of the line and strike line 5 in its entirety.
7. On page 6, line 25, strike "an offense" and insert in lieu thereof "a felony".
8. On page 7, line 1, strike the comma and the remainder of the line, strike line 2 in its entirety and insert in lieu thereof a period.
