AN ACT

RELATING TO CAPITAL OUTLAY FUNDING; REQUIRING WEB-BASED, USER-FRIENDLY PUBLICATION OF CAPITAL OUTLAY APPROPRIATION OR BOND AUTHORIZATION ALLOCATIONS BY LEGISLATIVE MEMBERS AND THE GOVERNOR; DECLARING AN EMERGENCY.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of Chapter 2, Article 3 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] CAPITAL OUTLAY FUNDING ALLOCATIONS--MEMBERS AND GOVERNOR--WEB-BASED PUBLICATION.--

          A. Notwithstanding the provisions of Section 2-3-13 NMSA 1978, the legislative council service shall publish on the legislative website a searchable listing of capital projects and the names of legislators or the governor who allocated a portion of the capital outlay appropriation or bond authorization for each project and the amount of the allocation designated by each legislator and the governor. The capital projects listing shall be designed to be as user-friendly as practicable and shall be published within three days after the governor has acted on the capital outlay bill.

          B. The legislative council service shall provide paper copies of the web-based publication if requested."

     SECTION 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
