A JOINT RESOLUTION

PROPOSING AN AMENDMENT TO ARTICLE 8 OF THE CONSTITUTION OF NEW MEXICO TO IMPOSE FOR A TEN-YEAR PERIOD A FIVE CENTS ($.05) PER GALLON TAX ON MOTOR VEHICLE FUELS, INCLUDING GASOLINE, SPECIAL FUELS AND ALTERNATIVE FUELS, TO BE USED FOR STATE ROADS AND HIGHWAYS.

 

BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. It is proposed to amend Article 8 of the constitution of New Mexico by adding a new section to read:

          "A. From July 1, 2017 through June 30, 2027, for the privilege of receiving or using gasoline, special fuels or alternative fuels, each as defined by law, there is imposed an excise tax at the rate of five cents ($.05) per gallon, and the receipts of this tax shall only be used for state roads and highways. The excise tax imposed by this subsection shall be separate from and in addition to any other tax imposed by law.

          B. The excise tax imposed by Subsection A of this section shall be collected, administered, distributed and appropriated as provided by law."

     SECTION 2. The amendment proposed by this resolution shall be submitted to the people for their approval or rejection at the next general election or at any special election prior to that date that may be called for that purpose.
