AN ACT

RELATING TO HEALTH; ENACTING A NEW SECTION OF THE LYNN AND ERIN COMPASSIONATE USE ACT TO BAN MEDICAL CANNABIS POSSESSION LIMITS FOR LICENSED PRODUCERS AND ESTABLISH A LICENSURE FEE LIMIT FOR LICENSED PRODUCERS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Lynn and Erin Compassionate Use Act is enacted to read:

     "[NEW MATERIAL] LICENSED PRODUCERS--BAN ON PLANT POSSESSION LIMITATION--FEE.--

          A. The department shall not limit the number of plants that a licensed producer may possess.

          B. On an annual basis and in accordance with department rules, an applicant for licensure shall submit an application for licensure or renewal of licensure. The application shall include a production plan that specifies the number of plants the applicant intends to possess during the upcoming fiscal year.

          C. The department shall assess a licensed producer an annual license fee that shall not exceed two thousand dollars ($2,000) per plant."
