AN ACT

RELATING TO CAPITAL OUTLAY FUNDING; REQUIRING PRINT AND WEB-BASED, USER-FRIENDLY PUBLICATION OF CAPITAL OUTLAY APPROPRIATION OR BOND AUTHORIZATION ALLOCATIONS BY LEGISLATIVE MEMBERS AND THE GOVERNOR AND OF PROJECTS VETOED BY LINE ITEM; DECLARING AN EMERGENCY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of Chapter 2, Article 3 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] CAPITAL OUTLAY FUNDING ALLOCATIONS--MEMBERS AND GOVERNOR--PUBLICATION.--

          A. Notwithstanding the provisions of Section 2-3-13 NMSA 1978, the legislative council service shall, within three days after the governor has acted on a capital outlay bill, publish on the New Mexico legislature website a searchable listing, designed to be as user-friendly as practicable, of capital projects in the bill that includes:

                (1) the name of the person, whether a legislator or the governor, who allocated all or a portion of the appropriation or bond authorization for each project;

                (2) the amount allocated by that person for the project;

                (3) projects vetoed by line item; and

                (4) for each line-item vetoed project, the name of each person who requested an allocation for the project and the amount of that allocation.

          B. The legislative council service shall provide a paper copy of the web-based publication upon request."

     SECTION 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
