    Your BUSINESS AND INDUSTRY COMMITTEE, to whom has been referred

SENATE CORPORATIONS AND TRANSPORTATION COMMITTEE SUBSTITUTE

 FOR SENATE BILL 46, as amended

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

1. Strike Item 2 of Senate Floor Amendment number 1.

     2. On page 3, line 24, strike "each active number" and insert in lieu thereof "the number of VoIP lines for which the VoIP service provider enables the capacity for simultaneous calls, regardless of actual usage, to be connected to the public switched telephone network during the period for which the fixed charge is imposed".

     3. On page 4, line 4, strike the period.

     4. On page 4, strike lines 5 through 8 in their entirety and strike line 9 up to the semicolon.

     5. On page 4, line 12, after "means", insert ", regardless of the technology used,".

     6. On page 4, line 15, after "equipment", insert ", or the functional equivalent thereof,".

     7. On page 5, line 3, after "voice", insert ", text".

     8. On page 5, line 4, strike "both" and insert in lieu thereof "any combination of these".

     9. On page 5, line 6, strike "and".

     10. On page 5, line 11, after the semicolon, insert:

"and

                (5) manage or administer the functions listed in Paragraphs (1) through (4) of this subsection;".

     11. On page 7, line 15, strike "calls" and insert in lieu thereof "communications".

     12. On page 7, line 16, strike "calls" and insert in lieu thereof "communications".

     13. On page 7, line 21, strike "call" and insert in lieu thereof "communication".

     14. On page 8, line 6, strike "call" and insert in lieu thereof "communication".

     15. On page 16, line 1, strike "willful or wanton negligence or".,

and thence referred to the STATE GOVERNMENT, INDIAN AND VETERANS' AFFAIRS COMMITTEE.
