AN ACT

RELATING TO COURTS; CREATING THE JUDGE PRO TEMPORE FUND TO PAY THE COSTS OF JUDGES PRO TEMPORE; DECLARING AN EMERGENCY.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. [NEW MATERIAL] JUDGE PRO TEMPORE FUND--CREATED.--There is created in the state treasury the "judge pro tempore fund" to be administered by the administrative office of the courts. The fund shall be used to pay the costs of judges pro tempore. The fund shall consist of appropriations, gifts, grants, donations and bequests made to the fund. Income from the fund shall be credited to the fund, and money in the fund shall not revert or be transferred to any other fund at the end of a fiscal year. Payments from the judge pro tempore fund shall be made upon vouchers issued and signed by the director of the administrative office of the courts or the director's designee upon warrants drawn by the secretary of finance and administration.

     SECTION 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
