AN ACT

RELATING TO PUBLIC RECORDS; REQUIRING INVESTIGATION REPORTS TO BE PROVIDED TO THE PARENT OF A STUDENT INVOLVED IN AN INVESTIGATION WHEN MISCONDUCT HAS BEEN ALLEGED AGAINST A SCHOOL DISTRICT LAW ENFORCEMENT OFFICER.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Inspection of Public Records Act is enacted to read:

     "[NEW MATERIAL] INVESTIGATION OF SCHOOL DISTRICT LAW ENFORCEMENT OFFICERS--REPORT TO PARENT IF STUDENT INVOLVED.-- The findings and disposition of an internal or external investigation of a school district law enforcement officer's misconduct while performing the officer's duties as a public official shall be provided to a parent if a student was involved in the alleged misconduct. The report shall include witness statements, field investigation reports and forensic interviews that do not contain or have redacted protected personal identification or other information determined to be confidential pursuant to federal or state law."
