AN ACT

RELATING TO RAILROAD SAFETY; ALLOWING FOR SAFETY INSPECTIONS OF RAILROAD PROPERTY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of Chapter 63, Article 3 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] RAILROAD SAFETY--SAFETY INSPECTIONS.--The collective bargaining representative for each craft of railroad worker and the state director for each craft may monitor the safety practices and operations on each railroad operating in New Mexico. Inspections may include taking photographs, examinations and investigations on railroad property as necessary to determine the railroad's compliance with applicable safety laws and rules and the presence of any safety hazard that may result in injury or death to a railroad employee. Noncompliance with safety laws and rules or the presence of a safety hazard shall be reported to the railroad and the public regulation commission."
