AN ACT

RELATING TO PUBLIC SALARIES; PROVIDING A TWO AND ONE-HALF PERCENT SALARY INCREASE FOR ALL STATE AND PUBLIC SCHOOL EMPLOYEES; MAKING APPROPRIATIONS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. APPROPRIATIONS.--

          A. Twenty-three million four hundred ninety thousand dollars ($23,490,000) is appropriated from the general fund to the department of finance and administration for expenditure in fiscal year 2019 to provide annual average salary increases of two and one-half percent to state employees in budgeted positions who have completed their probationary period subject to satisfactory job performance. This appropriation includes permanent legislative employees, child support hearing officers, special commissioners, all judicial permanent employees and all district attorney permanent employees, incumbents in agencies governed by the Personnel Act, the New Mexico state police career pay system, attorney general employees, workers' compensation judges and executive exempt employees. The salary increases shall be effective the first full pay period after July 1, 2018.

          B. Fifty-one million one hundred eighty-six thousand forty-four dollars ($51,186,044) is appropriated from the general fund to the state equalization guarantee distribution for expenditure in fiscal year 2019 to provide a two and one-half percent annual average salary increase for all teachers, other instructional staff, other licensed and unlicensed school employees and transportation employees. The salary increases shall be effective the first full pay period after July 1, 2018. This amount does not include and is in addition to salary increases due to licensure advancement pursuant to the School Personnel Act. The secretary of public education shall not approve the operating budget of a school district or charter school that does not provide an annual average two and one-half percent salary increase for all school employees and transportation employees specified in this subsection, that does not prioritize salary increases for instructional staff and that disproportionately allocates salary increases for central office administrators.

          C. Fourteen million one hundred seventeen thousand five hundred dollars ($14,117,500) is appropriated from the general fund to the higher education department for expenditure in fiscal year 2019 to provide faculty and staff of two-year and four-year public post-secondary educational institutions with an annual average salary increase of two and one-half percent. The salary increases shall be effective the first pay period after July 1, 2018.

          D. The department of finance and administration shall distribute a sufficient amount to each agency to provide the appropriate increase for those employees whose salaries are received as a result of the general fund appropriations in the General Appropriation Act of 2018.

          E. For those state employees whose salaries are referenced in or received as a result of non-general fund appropriations in the General Appropriation Act of 2018, the department of finance and administration shall transfer from the appropriate fund to the appropriate agency the amount required for the salary increases equivalent to those otherwise provided for in this section. Such amounts are appropriated for expenditure in fiscal year 2019. Any unexpended or unencumbered balance remaining at the end of fiscal year 2019 shall revert to the appropriate fund.

          F. Any unexpended or unencumbered balance remaining at the end of fiscal year 2019 from an appropriation made from the general fund in this section shall revert to the general fund.
