    Your CONSUMER & PUBLIC AFFAIRS COMMITTEE, to whom has been referred

 

HOUSE BILL 135

 

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

 

    1. On page 2, lines 7 and 8, strike "an untested kit" and insert in lieu thereof "a kit that is not associated with a reported crime".

 

     2. On page 3, line 5, after "assault", strike the remainder of the line and strike line 6 up to the period.

 

     3. On page 3, line 7, after "agency", insert "or crime laboratory".

 

     4. On page 3, line 8, strike "from a medical provider".

 

     5. On page 3, line 13, after "to", insert "have the kit tested within ninety days and the right to".

 

     6. On page 3, strike lines 20 through 23.

 

     7. Renumber the succeeding paragraphs accordingly.

 

     8. On page 4, line 3, after the subparagraph designation "(b)", insert "upon completion of the law enforcement investigation,".

 

     9. On page 4, line 5, after the subparagraph designation "(c)", insert "upon completion of the law enforcement investigation,".

 

     10. On page 4, lines 18 through 20, strike Subsection D in its entirety and insert in lieu thereof the following new subsection:

 

          "D. A crime laboratory shall:

 

                (1) complete the processing of a sexual assault examination kit within sixty days of receipt of the kit; and

 

                (2) preserve a kit for twenty-four months if the survivor has not reported the crime or, if the survivor has reported the crime, until the time within which the person who committed the crime may be prosecuted, tried or punished has expired.".

 

     11. On page 5, line 18, after "to", strike the remainder of the line, strike lines 19 through 22 and insert in lieu thereof "request a different officer if the survivor believes the officer to be unsupportive or inadequately trained.".

 

     12. On page 6, line 14, strike "legal counsel" and insert in lieu thereof "an advocate".,

 

and thence referred to the JUDICIARY COMMITTEE.
