    Your JUDICIARY COMMITTEE, to whom has been referred

 

HOUSE BILL 414

 

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

 

    1. On page 2, line 17, after the subsection designation "A.", strike "A" and insert in lieu thereof "Except as provided pursuant to Subsection C of this section, a".

 

    2. On page 3, line 16, strike the closing quotation mark.

 

    3. On page 3, between lines 16 and 17, insert the following new subsections:

 

         "C. The provisions of this section shall not apply to circumstances in which a nursing facility is involuntarily closed due to termination of the nursing facility's participation in medicare or medicaid by state or federal authorities.

 

         D. As used in this section:

 

              (1) "medicaid" means the joint federal-state health coverage program pursuant to Title 19 or Title 21 of the federal Social Security Act and rules promulgated pursuant to that act; and

 

              (2) "medicare" means health coverage provided pursuant to the federal Health Insurance for the Aged Act, Title 18 of the federal Social Security Amendments of 1965, as then constituted or later amended."".
