AN ACT

RELATING TO SCHOOL TRANSPORTATION; REQUIRING AT LEAST ONE ATTENDANT ON ANY SCHOOL BUS CARRYING DISABLED STUDENTS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of Chapter 22, Article 16 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] ATTENDANT REQUIRED ON SCHOOL BUSES CARRYING DISABLED STUDENTS.--

          A. There shall be at least one adult attendant on any school bus carrying one or more disabled student. The attendant shall sit with or near the disabled students. The department may provide by rule for the attendant to disabled student ratio required if there is more than one disabled student on the school bus. The ratio may take into account the type and severity of each student's disability.

          B. A school bus attendant shall be trained in advanced first aid and cardiopulmonary resuscitation. If a student requires regularly scheduled medication or might need emergency medication, the school bus attendant shall be certified as a medication aide by the board of nursing and shall be trained by the school nurse or a student's medical provider in how to properly administer that student's medication. The department or a school district or charter school may provide for additional training requirements or more stringent requirements than provided in this section."
