AN ACT

RELATING TO CRIMINAL LAW; CREATING THE CRIME OF CRIMINAL DAMAGE TO PROPERTY BY STEALING REGULATED MATERIAL.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of Chapter 30 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] CRIMINAL DAMAGE TO PROPERTY BY STEALING REGULATED MATERIAL.--

          A. Criminal damage to property by stealing regulated material consists of damaging the real or personal property of another in the commission of stealing regulated material when the cost of repair to the real or personal property is more than three thousand dollars ($3,000). Whoever commits criminal damage to property by stealing regulated material is guilty of a third degree felony.  

          B. For purposes of this section, "regulated material" has the same meaning as set forth in Section 57-30-2 NMSA 1978."

     SECTION 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2019.
