AN ACT

RELATING TO PUBLIC HEALTH; REQUIRING THE DEPARTMENT OF HEALTH TO ADOPT RULES REQUIRING HOSPITALS AND FREESTANDING BIRTHING CENTERS TO PROVIDE TRAINING AND EDUCATIONAL MATERIALS CONCERNING INFANT SAFE SLEEP ENVIRONMENTS AND SUDDEN UNEXPECTED INFANT DEATH TO NEW PARENTS OR LEGAL GUARDIANS PRIOR TO DISCHARGE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Public Health Act is enacted to read:

     "[NEW MATERIAL] INFANT SAFE SLEEP EDUCATION--DEPARTMENT TO ADOPT RULES.--

          A. By December 31, 2019, the department shall adopt rules requiring each hospital and freestanding birthing center to provide training and educational materials concerning infant safe sleep environments and sudden unexpected infant death, which materials shall include documents developed by a statewide or nationally recognized medical association or organization concerned with reducing the prevalence of sudden unexpected infant death, to every parent or legal guardian of a child under the age of one year prior to discharge from the hospital or freestanding birthing center.

          B. The rules shall:

                (1) require a nurse or another designated staff person to review training and educational materials with the parent or legal guardian prior to discharge and to discuss best practices to reduce the likelihood of sudden unexpected infant death;

                (2) require that training and educational materials be provided in the preferred language of the parent or legal guardian;

                (3) require each hospital and freestanding birthing center to maintain records regarding its provision of training and educational materials; and

                (4) prohibit each hospital and freestanding birthing center from imposing a fee for training or educational materials provided."
