AN ACT

RELATING TO PUBLIC ASSISTANCE; ENACTING A NEW SECTION OF THE PUBLIC ASSISTANCE ACT TO REQUIRE THE HUMAN SERVICES DEPARTMENT TO ESTABLISH A MINIMUM REIMBURSEMENT RATE FOR OPIOID REPLACEMENT THERAPY TO TREAT OPIOID USE DISORDER.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Public Assistance Act is enacted to read:

     "[NEW MATERIAL] MEDICAL ASSISTANCE--OPIOID REPLACEMENT THERAPY--MINIMUM REIMBURSEMENT RATE.--

          A. The department shall ensure that a health care provider that provides opioid replacement therapy to treat opioid use disorder to recipients is reimbursed at a bundled reimbursement rate, such that, for each unit of opioid replacement therapy that the health care provider provides, at least seventeen dollars ($17.00) is reimbursed to the health care provider; provided that the reimbursement rate shall be adjusted annually after July 1, 2022 for any increase from the preceding year in the consumer price index for the United States in the urban market for the west region.

          B. As used in this section, "opioid replacement therapy to treat opioid use disorder" means:

                (1) the administration, procurement and dispensing of methadone;

                (2) the provision of at least one hour per month of substance abuse counseling, which counseling includes, where appropriate, counseling related to human immunodeficiency virus risk and infection; and

                (3) urine dipstick testing conducted within the provider agency."
