AN ACT

RELATING TO CIVIL ACTIONS; ENACTING A STATUTE OF REPOSE FOR ACTIONS AGAINST PROFESSIONAL SURVEYORS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of Chapter 37, Article 1 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] SURVEYING--LIMITATION ON ACTIONS.--Except for an action for fraud, no action against a professional surveyor licensed pursuant to the Engineering and Surveying Practice Act to recover damages for negligence, errors or omissions in the making of a survey or for contribution or indemnity related to such acts, errors or omissions shall be brought after ten years from the date of signature and seal of the professional surveyor on the completed survey, or delivery of the completed survey, whichever date occurs first."
