AN ACT

RELATING TO PROFESSIONAL LICENSURE; ENACTING A NEW SECTION OF THE MEDICAL PRACTICE ACT TO ESTABLISH A NEW REQUIREMENT FOR LICENSURE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Medical Practice Act is enacted to read:

     "[NEW MATERIAL] CONDITION OF LICENSURE--MEMBERSHIP IN PROFESSIONAL SOCIETY--RULEMAKING.--

          A. A physician who contributes as a qualified health care provider to the patient's compensation fund established pursuant to Section 41-5-25 NMSA 1978 in accordance with the provisions of the Medical Malpractice Act shall, as a condition of licensure as a physician, join and retain membership in the state professional society that provides administrative services for the New Mexico medical review commission.

          B. By August 1, 2019, the board shall issue guidelines to encourage physicians to volunteer as panelists pursuant to Section 41-5-17 NMSA and to serve as expert witnesses pursuant to Section 41-5-23 NMSA 1978."
