AN ACT

RELATING TO LEGISLATIVE RETIREMENT; RESTRICTING ELIGIBILITY FOR STATE LEGISLATOR MEMBER COVERAGE PLAN 2.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. Section 10-11-43.1 NMSA 1978 (being Laws 2003, Chapter 85, Section 7) is amended to read:

     "10-11-43.1. STATE LEGISLATOR MEMBER COVERAGE PLAN 2--APPLICABILITY--RESTRICTING ELIGIBILITY.--

          A. Subject to Subsection B of this section, state legislator member coverage plan 2 is applicable to state legislators who receive no salary for their legislative service and lieutenant governors who serve terms of office that end after December 31, 2002. To be covered under state legislator member coverage plan 2, a state legislator or lieutenant governor must elect to be a member no later than one hundred eighty days after first taking office or, for state legislators and the lieutenant governor serving on July 1, 2003, within one hundred eighty days of that date.

          B. A person who becomes a state legislator or lieutenant governor on or after July 1, 2019 and who is at that time a member or retired member in the state system or the educational retirement system is not eligible to be covered under state legislator member coverage plan 2."
