AN ACT

RELATING TO OIL AND GAS; ALLOWING THE OIL CONSERVATION COMMISSION TO IMPOSE FEES; MAKING AN APPROPRIATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Oil and Gas Act is enacted to read:

     "[NEW MATERIAL] FEES--APPROPRIATION.--

          A. The commission may establish by rule a schedule of administrative filing fees, application fees and permit fees sufficient to cover the reasonable costs of the oil conservation division of the energy, minerals and natural resources department in reviewing, implementing and enforcing the terms and conditions of a granted order, application or permit pursuant to the Oil and Gas Act.

          B. The commission shall take into consideration size of the proposed operations, anticipated inspection frequency and other factors deemed relevant in determining the fees imposed pursuant to Subsection A of this section.

          C. All fees collected pursuant of Subsection A of this section are appropriated to the division for the purpose of fulfilling the division's duties pursuant to the Oil and Gas Act."
