A JOINT RESOLUTION

PROPOSING TO AMEND ARTICLE 11 OF THE CONSTITUTION OF NEW MEXICO BY ADDING A NEW SECTION TO PROHIBIT, FOR THE PURPOSE OF ADDRESSING A STATEWIDE PUBLIC EMERGENCY, THE CLOSURE OF A BUSINESS WHILE ALLOWING ANOTHER BUSINESS IN THE SAME INDUSTRY TO REMAIN OPEN.

 

BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. It is proposed to amend Article 11 of the constitution of New Mexico by adding a new section to read:

     "Neither the state, nor a political subdivision, agency, department or instrumentality of the state, shall, for the purpose of addressing a statewide public emergency, require the closure of a place of business registered in the state while allowing another business registered in the state with the same North American industry classification system code or similar succeeding industry classification to remain open."

     SECTION 2. The amendment proposed by this resolution shall be submitted to the people for their approval or rejection at the next general election or at any special election prior to that date that may be called for that purpose.
