AN ACT

RELATING TO GENERAL APPROPRIATIONS; MAKING APPROPRIATIONS FROM LEGISLATIVE CASH BALANCES FOR NECESSARY EXPENSES OF THE SECOND SPECIAL SESSION OF THE FIFTY-FIFTH LEGISLATURE; MAKING APPROPRIATIONS FROM THE GENERAL FUND TO THE HOUSE AND SENATE CHIEF CLERKS' OFFICES FOR LEADERSHIP STAFF AND ONGOING OPERATIONAL EXPENSES; MAKING CONTINGENT APPROPRIATIONS FROM THE APPROPRIATION CONTINGENCY FUND FOR NECESSARY JUDICIAL AND EXECUTIVE BRANCH EXPENSES RELATED TO PRETRIAL SERVICES MONITORING AND ADMINISTRATION, ACCOUNTING AND REPORTING OF FUNDS RECEIVED BY THE STATE PURSUANT TO THE FEDERAL AMERICAN RESCUE PLAN ACT OF 2021.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. SPECIAL SESSION--APPROPRIATION.--

          A. The following amounts are appropriated from legislative cash balances for expenditure in fiscal year 2022 for the following expenses of the second special session of the fifty-fifth legislature:

                (1) for the expense of the house of representatives, three hundred twenty-two thousand three hundred dollars ($322,300) to be disbursed on vouchers signed by the speaker and the chief clerk of the house of representatives or the chief clerk's designee;

                (2) for the expense of the senate, three hundred five thousand four hundred dollars ($305,400) to be disbursed on vouchers signed by the chair of the committees' committee and the chief clerk of the senate or the chief clerk's designee; and

                (3) for the expense of the legislative council service, two hundred eighty-six thousand four hundred dollars ($286,400) to be disbursed on vouchers signed by the director of the legislative council service or the director's designee.

          B. Following adjournment of the second special session of the fifty-fifth legislature, expenditures authorized in this section shall be disbursed on vouchers signed by the director of the legislative council service or the director's designee.

     SECTION 2. APPROPRIATIONS--GENERAL FUND--HOUSE AND SENATE LEADERSHIP STAFF AND ONGOING OPERATIONAL EXPENSES.--

          A. There is appropriated from the general fund to the legislative council service for expenditure in fiscal years 2022 and 2023:

                (1) three hundred fifty thousand dollars ($350,000) to the house chief clerk's office for leadership staff and ongoing operational expenses as determined by house leadership, to be disbursed on vouchers signed by the director of the legislative council service; and

                (2) three hundred fifty thousand dollars ($350,000) to the senate chief clerk's office for leadership staff and ongoing operational expenses as determined by senate leadership, to be disbursed on vouchers signed by the director of the legislative council service.

          B. Any unexpended or unencumbered balance remaining at the end of fiscal year 2023 shall revert to the general fund.

     SECTION 3. APPROPRIATIONS--APPROPRIATION CONTINGENCY FUND--EXECUTIVE AND JUDICIAL BRANCHES.--Contingent upon the transfer of federal funds received in the state treasury in the coronavirus state fiscal recovery fund pursuant to the federal American Rescue Plan Act of 2021, Sec. 9901, Public Law 117-2, 135 Stat. 223, to the appropriation contingency fund pursuant to legislation of the second special session of the fifty-fifth legislature, making general appropriations and authorizing expenditures, the following amounts are appropriated from that amount transferred to the appropriation contingency fund for expenditure in fiscal years 2022 through 2025, and any unexpended or unencumbered balance remaining at the end of fiscal year 2025 shall revert to the appropriation contingency fund:

          A. five hundred thousand dollars ($500,000) to the administrative office of the courts for pretrial services monitoring; and

          B. one million dollars ($1,000,000) to the department of finance and administration for costs relating to the administering, accounting and reporting of funds received by the state pursuant to the federal American Rescue Plan Act of 2021.
