AN ACT

MAKING AN APPROPRIATION TO THE DEPARTMENT OF INFORMATION TECHNOLOGY FOR THE DEVELOPMENT OF A CYBERSECURITY PROGRAM FOR ALL SCHOOL DISTRICTS, CHARTER SCHOOLS AND STATE SPECIAL SCHOOLS AND THE STATEWIDE EDUCATION TECHNOLOGY INFRASTRUCTURE NETWORK BY THE END OF FISCAL YEAR 2026.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. APPROPRIATION.--

          A. Forty-five million dollars ($45,000,000) is appropriated from the general fund to the department of information technology for expenditure in fiscal years 2023 through 2026 for three full-time employees and to develop and implement a cybersecurity program that meets the standards required by federal cybersecurity assistance programs to states or educational institutions for all school districts, charter schools, state special schools and the statewide education technology infrastructure network developed pursuant to Section 22-24-4.5 NMSA 1978. The cybersecurity program shall include cybersecurity insurance support, cybersecurity planning and project management, development of a response and recovery plan and quarterly reviews, hardening of cyber-environment infrastructure, operations, processes and systems, monitoring network activity and training for employees and students. The expenditure per year shall be as follows:

                (1) eight million dollars ($8,000,000) in fiscal year 2023 to plan, implement and maintain a cybersecurity program for a minimum of thirty-five school districts and eighteen charter schools or state special schools;

                (2) ten million dollars ($10,000,000) in fiscal year 2024 to maintain the cybersecurity program and extend it to a minimum of an additional twenty school districts and eighteen charter schools or state special schools;

                (3) twelve million dollars ($12,000,000) in fiscal year 2025 to maintain the cybersecurity program and extend it to a minimum of an additional sixteen school districts and eighteen charter schools or state special schools; and

                (4) fifteen million dollars ($15,000,000) in fiscal year 2026 to maintain the cybersecurity program and extend it to the remaining school districts, charter schools and state special schools that were not included in the program by the expenditures in fiscal years 2023 through 2025.

          B. Any unexpended or unencumbered balance remaining at the end of fiscal year 2026 shall revert to the general fund.
