AN ACT

RELATING TO STATE PERSONNEL; REQUIRING STATE EMPLOYEES TO BE PHYSICALLY PRESENT AT THEIR PLACE OF EMPLOYMENT; PROVIDING EXCEPTIONS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. Section 10-9-15 NMSA 1978 (being Laws 1961, Chapter 240, Section 10) is amended to read:

     "10-9-15. DUTIES OF STATE OFFICERS AND EMPLOYERS.--

          A. All officers and employers of the state shall comply with the Personnel Act.

          B. All employers shall:

                (1) hire employees only from employment lists of applicants who meet prescribed minimum requirements and have passed the prescribed tests provided by the director; and

                (2) require employees to be physically present at their place of employment when carrying out duties related to that employment; provided that accommodations may be provided:

                     (a) to comply with other applicable federal law;

                     (b) if the duties related to that employment require travel away from the place of employment;

                     (c) in the event that the place of employment is unable to be physically occupied; or

                    (d) in the event private employers reduce their in-person workforce by fifty percent or greater in response to a public health emergency, as determined by the workforce solutions department.

          C. All officers and employers shall furnish any records or information [which] that the director or the board requests."
