AN ACT

RELATING TO CANNABIS; DISTRIBUTING A PORTION OF THE REVENUE FROM THE CANNABIS EXCISE TAX TO A NEW SUBSTANCE USE DISORDER TREATMENT FUND; CREATING THE SUBSTANCE USE DISORDER TREATMENT FUND; MAKING AN APPROPRIATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Tax Administration Act is

enacted to read:

     "[NEW MATERIAL] DISTRIBUTION--CANNABIS EXCISE TAX-- SUBSTANCE USE DISORDER TREATMENT FUND.--A distribution pursuant to Section 7-1-6.1 NMSA 1978 shall be made to the substance use disorder treatment fund in an amount equal to ten percent of the net receipts attributable to the cannabis excise tax."

     SECTION 2. [NEW MATERIAL] SUBSTANCE USE DISORDER TREATMENT FUND.--The "substance use disorder treatment fund" is created in the state treasury. The human services department shall administer the fund, and money in the fund is appropriated to that department to provide statewide substance use disorder treatment. Money in the fund shall be disbursed on warrants signed by the secretary of finance and administration pursuant to vouchers signed by the secretary of human services or the secretary's authorized representative. Any unexpended or unencumbered balance remaining at the end of a fiscal year shall revert to the general fund.

     SECTION 3. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2022.
