AN ACT

RELATING TO THE CHILDREN'S CODE; REQUIRING THAT POLICIES AND PROCEDURES OF THE CHILDREN, YOUTH AND FAMILIES DEPARTMENT BE PROMULGATED IN ACCORDANCE WITH THE STATE RULES ACT.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of Chapter 32A, Article 1 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] RULES--ADOPTION AND PROMULGATION--EXCEPTIONS.--

          A. As used in this section, "rule" means a rule, regulation, order, standard, policy or procedure that purports to affect one or more governmental agencies other than the department or that purports to affect persons who are not employees of the department.

          B. Rules of the department shall be adopted, promulgated and filed as provided in the State Rules Act."
