AN ACT

RELATING TO EDUCATION; RESTRICTING THE USE OF "LATINX" AND SIMILAR TERMS IN POST-SECONDARY EDUCATIONAL INSTITUTIONS, PUBLIC SCHOOLS AND INSTRUCTIONAL MATERIALS USED WITHIN THE CLASSROOM WHEN USED AS AN ALL-ENCOMPASSING TERM IN REFERENCE TO PEOPLE OF HISPANIC DESCENT.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of Chapter 21 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] RESTRICTION OF LATINX IN POST-SECONDARY EDUCATIONAL INSTITUTIONS AND INSTRUCTIONAL MATERIALS USED WITHIN THE CLASSROOM IN CERTAIN CIRCUMSTANCES.--Beginning in the 2023 fall semester and for subsequent semesters thereafter, a post-secondary educational institution shall not allow the term "Latinx" or "LatinX" to be used in any classroom setting when the term is used as an all-encompassing term in reference to people of Hispanic descent. A post-secondary educational institution shall not use or purchase any instructional materials for use within a classroom containing the term "Latinx" or "LatinX" when the term is used as an all-encompassing term in reference to people of Hispanic descent."

     SECTION 2. A new section of the Public School Code is enacted to read:

     "[NEW MATERIAL] RESTRICTION OF LATINX IN SCHOOLS AND INSTRUCTIONAL MATERIALS USED WITHIN THE CLASSROOM IN CERTAIN CIRCUMSTANCES.--Beginning in the 2023-2024 school year, a public school shall not allow the term "Latinx" or "LatinX" to be used in any school setting, including after-school programs offered by the school district, when the term is used as an all-encompassing term in reference to people of Hispanic descent. A public school shall not use or purchase any instructional materials for use within a classroom containing the term "Latinx" or "LatinX" when the term is used as an all-encompassing term in reference to people of Hispanic descent."
